Please read these terms carefully

These Terms of Use explain the conditions under which you may use the My Lichess Online Analyzer (MyLOA) software and this website. By accessing the website, downloading, installing, or using the Software, you agree to be bound by these Terms.

These Terms apply to any visitor to the website, anyone who downloads or uses the Software, and anyone who purchases a Pro license or opening book, whether on this website or through any other channel we specify.

These Terms work together with our Privacy Policy and Cookie Policy, which describe how we handle your personal data and use cookies. By using the website or Software, you also acknowledge that you have read those documents.

If you do not agree with these Terms, you must not use the website, download the Software, or purchase any Pro license or opening book. If you continue to use the website or Software after changes to these Terms are posted, you are considered to have accepted the updated Terms.
How terms are used in these conditions

Software means the My Lichess Online Analyzer (MyLOA) programs, including the Free and Pro versions, any updates, patches, or new versions that we may release, and any bundled tools we provide.

Website means the site available at https://www.chessopeninganalyzer.com/ and any subpages we operate to present, distribute, or support the Software and related products.

User means any person who visits the Website, downloads or uses the Software, or purchases or uses a Pro license or opening book, whether in a personal or professional capacity.

License means the right we grant you to use the Software or an opening book under these Terms. A License Key is the code or activation method we provide to unlock or validate a Pro license or specific opening book on your device.

Content means all material made available through the Website or Software, including text, graphics, logos, icons, images, downloadable files, opening books, and any analysis output generated by the Software.
How you may use MyLOA and our opening books

Subject to your compliance with these Terms and, where applicable, payment of the relevant fees, we grant you a personal, limited, revocable, non-exclusive, and non-transferable license to install and use the Software on your own devices for your own chess analysis purposes.

A Pro license allows you to use Pro-only features, such as analysis of chess.com games, as described on the Website at the time of your purchase. Unless explicitly stated otherwise, each Pro license is for one natural person and may not be shared with other individuals.

When you purchase an opening book, you receive a personal, non-exclusive, non-transferable license to use that opening book within the Software for your own study and analysis. You do not acquire any ownership rights in the underlying data or structure of the opening book.

You must not rent, lease, sell, sublicense, redistribute, or otherwise commercially exploit the Software or opening books, except as expressly allowed by us in writing. You must not attempt to bypass technical protection, remove or hide ownership notices, or use the Software or opening books to build a competing product.

You must not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the limited extent that applicable law explicitly permits you to do so despite this restriction.

We reserve all rights in and to the Software, Website, and opening books that are not expressly granted to you under these Terms. No rights are granted by implication or otherwise beyond those clearly described here.
Ordering, prices, payment, and refunds

You can order Pro licenses and opening books through the Download & Pricing page or through the Shop when available. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the chosen payment method.

Unless stated otherwise, prices are shown in euros and may include or exclude taxes depending on your location and the requirements of applicable tax law. Any additional taxes, fees, or charges will be shown during checkout where reasonably possible.

Payments are processed through third-party payment providers that we select. Your purchase may be subject to their terms and conditions and privacy policies. We do not store your full payment card details on our own systems.

Pro licenses, License Keys, and opening books are delivered digitally, for example by email, download link, or in-product activation. You are responsible for providing a valid email address and for saving any License Keys and files delivered to you.

Because Pro licenses and opening books are digital products that become available immediately, your statutory right of withdrawal may be limited or excluded once delivery has started, as permitted by law. Where we offer voluntary refunds, the conditions will be clearly described on the Website. Nothing in these Terms affects any mandatory rights you may have under consumer law.
What we expect from users

You are responsible for keeping any License Keys, activation details, and downloaded files secure and confidential. You must not share your License Keys publicly or with other users, except where a license is explicitly designated as multi-user by us.

You must use the Website, Software, and opening books only for lawful purposes and in accordance with these Terms and any applicable local laws. You must not attempt to disrupt, overload, or interfere with our servers, services, or other users.

You remain responsible for any game files, data, or other material that you import into the Software. You must ensure that you have the right to use and process that data and that your use does not infringe the rights of any third party.

You must not attempt to gain unauthorized access to any part of the Website or Software, introduce malware, bypass security or technical protections, or use the Software in a way that could damage our systems or reputation.

If you notice a problem, security issue, or bug, we encourage you to report it using the Bug Report page rather than trying to exploit it. Providing clear and accurate information helps us improve the Software for everyone.
Ownership of software, website, and opening books

The Software, the Website, and all related code, designs, and content are owned by us or our licensors and are protected by copyright and other intellectual property laws. You receive a license to use them, but you do not acquire ownership rights.

All opening books we provide or sell, including their structure, selection, and arrangement of moves, are protected intellectual property. You may not copy, extract, or redistribute them beyond what is necessary for your personal use with the Software.

My Lichess Online Analyzer, MyLOA, and any associated logos or product names used on the Website or in the Software may be protected as trademarks or distinctive signs. You may not use them in a way that could cause confusion about your relationship with us.

The Software may interact with third-party services such as Lichess or chess.com. Those names, logos, and services are the property of their respective owners, who are not responsible for and do not endorse this Software unless they explicitly state otherwise.

If you send us feedback, ideas, or suggestions about the Software or Website, you agree that we may use them for any purpose without obligation to compensate you, and that we will own any resulting improvements or derivative works, unless we agree otherwise in writing.
What we can and cannot promise

The Website and Software are provided on an as-is and as-available basis. We do not guarantee that they will be error-free, uninterrupted, or that any particular analytical result, playing strength improvement, or competitive outcome will be achieved.

The analysis, statistics, and recommendations produced by the Software are intended for training and informational purposes only. They do not constitute professional coaching, legal, or financial advice, and you remain responsible for how you use them in practice or competition.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or opportunities, arising out of or in connection with your use of the Website, Software, or opening books.

Where our liability cannot be excluded under applicable law, our total aggregate liability to you for all claims arising out of or relating to the Website, Software, or opening books will be limited to the amount you actually paid for the product or service that gave rise to the claim, unless a higher amount is required by mandatory law.

You are responsible for maintaining appropriate backups of your own data, including game collections and analysis results. We are not responsible for any loss or corruption of data that you store in or process through the Software, except where required by mandatory law.

Nothing in these Terms is intended to exclude or limit any rights you may have under mandatory consumer protection or other laws that cannot lawfully be excluded or limited in your country of residence.
When your access or license may end

You may stop using the Website and Software at any time and, where applicable, uninstall the Software from your devices. Stopping use does not automatically entitle you to a refund, except where required by law or by any specific refund policy we publish.

We may suspend or terminate your access to the Website, Software, or specific features, or deactivate your License Key, if you materially or repeatedly breach these Terms, misuse our products, attempt to circumvent technical protections, or if we are required to do so by law or by a court or authority.

If your license is terminated, your right to use the affected Software version or opening book ends immediately. You must stop using and, where reasonably possible, uninstall or delete the Software and any related License Keys from your devices, except for copies that you are legally required to keep.

Even after termination, certain provisions of these Terms that by their nature should survive will continue to apply. These include, for example, provisions on intellectual property, disclaimers, limitation of liability, and governing law and jurisdiction.
Which laws apply to these Terms

Unless a different law is mandatory in your country of residence, these Terms and any dispute or claim arising out of or relating to them, or to the Website, Software, or opening books, are governed by the laws of your country of establishment, without regard to conflict-of-law rules.

Subject to any mandatory rules that give you the right to bring claims in another court, the courts of our place of establishment will have exclusive jurisdiction over any dispute or claim arising out of or relating to these Terms, the Website, the Software, or the opening books.

If you are a consumer and your local law grants you additional rights regarding applicable law or jurisdiction, those rights remain unaffected by this section and will prevail where they cannot be limited by agreement.
How we update this document

We may update or modify these Terms from time to time, for example to reflect changes in the Software, new legal requirements, or improvements to our services and policies.

When we make material changes, we will post the updated Terms on this page and adjust the effective date at the top. For significant changes, we may also use additional channels such as prominent notices on the Website.

Unless we state otherwise, changes take effect as soon as the updated Terms are posted on the Website. By continuing to use the Website or Software after the updated Terms are published, you agree to be bound by the new version.

We recommend that you save or print a copy of the current Terms of Use for your records so that you can refer to them later if needed.
